Definition and function of cookies. What are they and what are they used for?

Types of cookies based on the entity managing them:

Depending on the entity that manages the computer or domain from which the cookies are sent and processes the data obtained, the following can be distinguished:

First-party cookies: Sent to the user's device from a domain managed by the website owner from which the desired service is provided.

Types of cookies based on their purpose:

Also belonging to this category, due to their technical nature, are those cookies that allow the management in the most efficient way possible, of the advertising spaces that, as another element of design or “layout” of the service offered to the user, the editor has included in a web page, application or platform based on criteria such as the edited content, without collecting information from users for different purposes, such as personalizing that advertising content or other content.

Technical cookies will be exempt from compliance with the obligations established in article 22.2 of the LSSI when they allow the provision of the service requested by the user, as is the case with the cookies listed in the previous paragraphs. Personalization or preference cookies: Allow the user to access the service with some general characteristics predefined according to a series of criteria in the user´s terminal, such as the language, the type of browser through which the user accesses the service, the regional configuration from the user accesses the service, etc.

If the user chooses these characteristics (for example, if he selects the language of a website by clicking on the icon of the flag of the corresponding country), the cookies will be exempt form the obligations of article 22.2 of the LSSI because they are considered a service expressly requested by the user, and this is only as long as the cookies obey the selected purpose.

Analytical or measurement cookies: Allow the person responsible for them to monitor and analyze the behavior of the users of the website to which they are linked. The information collected through this type of cookies is used to measure the activity of the websites, application or platform and to create browsing profiles of the users of said sites, applications or platforms, in order to introduce improvements based on the analysis of the data on the use made by the users of the service.

Regarding the processing of data collected through analysis cookies, the working group of article 29 has stated that, although they are not exempt from the duty to obtain informed consent for their use, it is unlikely that they represent a risk to the privacy of users provided that they are first-party cookies, that they process aggregated data for strictly statistical purposes, that information is provided on their use and that the possibility for users to express their refusal to use them is included.

Behavioral advertising cookies: Store information about users' browsing behavior obtain through continuous observation of their browsing habits, which allows the development of a specific profile for displaying targeted advertising.

Types of cookies based on duration:

Session cookies: Designed to collect and store data while the user is accessing a website. They are usually used to store information that is only of interest to the user for the provision of the service requested on a single occasion (for example, a list of purchased products) and they disappear when the session ends.
Persistent cookies: Data remains stored on the device and can be accessed and processed for a period defined by the cookie provider, ranging from minutes to several years.
